Last Friday, the U.S. Court of Appeals issued a ruling denying a petition by the Modesto and Turlock Irrigation Districts to waive the State Water Board’s authority to issue a Water Quality Certification (WQC) for inclusion in the federal licenses for Don Pedro and La Grange Dams on the Tuolumne River.
This is important because the WQC includes mandatory conditions, including flow requirements, that the Districts wanted to avoid. The Districts, as well as the SFPUC, still have pending lawsuits aimed at blocking the WQC, but for now, we can celebrate a big interim victory.
